You can't use both .
If you use EAD then h1b will be invaild.

I agree with you that you need to go with lawyers who are really specialized in immigration especially when the case is complicated.
I know a person whos company lawyer screwed up the case. (They are from a very reputed law firm). Then she went with Murthy, they did a great job and got it done for her. They charged her a lot but it was worth it.
So get the best out there. It may be expensive but if it fixes your case its worth it.

My previously filed PERM & I-140 are under the verge of rejection due to a pending RFE.
I am planning to file another PERM. Even though I'm trying to do it ASAP, I'm wondering whether I have an advantage on filing new PERM before Dec 20th 2007.
While applying for H1B extension in Dec 2008, If I have an approved labor/pending I-140 I thought I could request for 3 year extension. If I don't have labor/I-140 pending I can only request for 20 months extension (as my 6 year H1B term ends on Sep 2010)
I read from a site that...
"One in H1B/H-4 status can extend to the end of the 6-year limit, and then take advantage of the provisions allowing extensions beyond the 6-year limitation, if the labor certification or I-140 was filed at least a year earlier."
When I asked this question to my attorney he said

I always follow his articles.
I always felt that CIR was a impossible strategy. It bundles all the immigration bill in one single bill. The idea is that it would make the illegal legalization process more easier than in a piecemeal strategy where the easily passable ones like SKIL bill etc might pass leaving behind the more politically toxic rest.
Also what it does that it makes the CIR an isolated elephant which is hunted down by
a pack of wolves , in other words uniting the antis into one single consolidated powerful force.
Eventually the MALDEF head is realizing the folly of the logic and I feel in a Year or two CIR strategy will be abandoned for a piecemeal strategy.

Hi,
Our attorney prepared and filed our (mine and my wife's) 485, EAD and AP in July 2007.
We received our EAD and AP in 2007 and they are about to expire.
We are currently planning to renew our EAD and AP and wanted to apply on our own this time.
In that context, we requested for a copy of our application forms from the attorney.
We never got to verify the filled application forms until now (the attorney sent us only the pages to be signed at the time of filing)
To our surprise, we figured out the following mistakes in the application forms:
1) My I-94# in 485 and EAD application forms was wrongly mentioned. But I had my A# correct and it matches with the one on my EAD.
2) My wife's date of last entry in US was wrongly mentioned in 485 and EAD.
3) My mother's name was misspelled (a letter was missing from her first name)
I am not sure how bad the above mistakes are.
Here are my concerns now:
1) Are I-94# and last entry date used during namecheck or any other phase during the overall process? We didnot travel outside US since we applied 485. What if we travelled (the I-94 and last entry dates would have anyways changed).
Do we need to update these details explicitly after every travel? How important is it to get these details corrected in our applications?
2) If we apply for renewal of EAD and AP with the correct details this time, is it going to be fine? Do we still need to get them fixed in our 485?
OR
Will it be a problem for renewal because the details are different from the original application?
3) What is the procedure to follow in this situation?
Any advice in this matter is greatly appreciated.

From your post it is not clear if your 140 is already approved or pending.
Anyhow, assuming it is approved and he cancels, then an RFE is bound to come, it is best to file for AC21 with new employer, since RFE could also involve EVL with recent paystubs................. now since in your case even your new job is with a consulting company (do not know how big it is), you might get stuck with RFE too.

Hi,
Please help me with my situation below:
1) Got laid off from company A (they haven't cancelled my H1).
2) Got my H1B transferred to company B (this H1B transfer has not yet been approved). I did not work for them.
3) I did premium processing for H1B transfer for company C and got it approved. I haven't started working for them.
4) Now I have decided to work for company D. They are ready to do my H1B transfer.
Will that be a problem or do I have to go with company C? I do not have paystubs from company B and C. If I have to reenter US, will that be a problem? Please help me out.

Use a good lawyer who can help with interpretation. USCIS has been flexible about the "same or similar" job thing , unless the jobs are entirely in a different occupation.
